My QME report had my injury date wrong by 14 months and the adjuster just rolled with it
So last Tuesday I finally got a copy of the QME report from my back injury and the doctor wrote that my injury happened in March 2023. It happened May 2022, I know this for a fact since I still have the incident report from my warehouse job in Stockton with that date on it. I called the adjuster at the claims office and she said they go by the report date unless I dispute it in writing, which nobody told me I could even do. Now my PD rating got calculated off the wrong date and it dropped my number by about $8,400 according to my attorney's quick math. I sent a written correction letter with the incident report attached plus my old urgent care paperwork from the week it happened. Has anyone else had a QME just get the date flat wrong and did pushing back actually fix it or did it just drag the case out longer?
That 14 month gap is going to matter more than they want to admit since the whole PD rating table shifts with the date. I'd make sure your letter went certified mail with the return receipt, because the claims office will happily claim they never got it and let the clock run. Keep the incident report and urgent care notes as your paper trail, they beat the QME's memory every time.
